Media Briefing Note (Aubin and Wateridge) from Royal Court of Jersey

The indictments of Michael Aubin, and Gordon Claude Wateridge, will take place on 24 October 2008 at the Royal Court, St Helier, Jersey.

These indictments are linked to the States of Jersey Police investigation into alleged offences relating to Haut de la Garenne children's home.

The indictments will consist of a document signed by HM Attorney General setting out the statement and particulars of the offence(s) with which each of the accused is charged being read in Court. The defendants, through their advocates, will enter a plea (guilty or not guilty) to each of the counts on the indictment.

The indictments will commence at 10am and each indictment is expected to last 10 minutes.

If a guilty plea is entered, the Crown Advocate will ask that the accused be remanded (in custody or on other terms) until a particular date and time, to be sentenced.

If a not guilty plea is entered, the Crown Advocate will move that the defendant be remanded (in custody or otherwise) until a date to be tried.

If the defendant pleads not guilty, the Crown Advocate will ask the Court to fix a date for a Pre-trial Review and Directions hearing “ a hearing designed to ensure that cases are dealt with efficiently and that any matters of law are dealt with prior to trial.

Journalists in the Courtroom will be expected to remain seated throughout each session. Mobile phones and BlackBerrys must be switched off in the Courtroom.
